The Moscow city court upheld the decision to block the social network LinkedIn in Russia

The Moscow city court today in the appeal case was heard on the blocking in Russia social network LinkedIn, has upheld the decision of the court of first instance from 4 August, which access to the specified resource needs to be restricted, and the site entered in the register of infringers of rights of personal data subjects.

Thus, the court supported the position of Roskomnadzor, confirmed the failure of the social network of the law “On personal data”, in particular, requirements for localization of servers with user data on the territory of Russia. According to the Agency, such actions violate “the rights and freedoms of man and citizen”.

LinkedIn continues to store data of Russians abroad, and collects and transmits information about Russian citizens without their consent — including those that are not even users of the social network. According to Roskomnadzor, this is not only a gross violation of the law “On personal data”, but also an attack on the inviolability of private life of citizens.

According to the position of the social network, for processing the data of users outside the USA, says the LinkedIn Ireland, not the LinkedIn Corporation which is the defendant in the suit of Roscomnadzor, TASS said. “Evidence that the American company LinkedIn Corporation extends is a defendant in the case and responsible for processing personal data of Russian users of the network, Roskomnadzor has not provided,” — said in court the company’s lawyer.

The representative of Roskomnadzor has rejected the statement of lawyers on LinkedIn improper defendant in the case. “We make a complaint to the registrant, which is LinkedIn Corporation. This company, according to information from its official website, is responsible for the information and services provided through facilities located in the US and owned by LinkedIn Corporation”, – said the lawyer of the Ministry.

Since the court decision comes into force, Roskomnadzor received the right to make a binding order for providers and operators about blocking LinkedIn.
