Apple had violated the law “On protection of competition”, because the coordinated prices on six models of the iPhone. This conclusion came FAS. Now the service intends to charge the company a penalty.
According to RBC, the FAS found the company “eppl Rus” is the Russian “daughter” of Apple, responsible for coordinating prices on iPhone 5s, iPhone 5c, iPhone 6, iPhone 6 Plus, iPhone 6s and iPhone 6s Plus. Thus, the company violated the law “On protection of competition”. At the same time in the price of the iPhone 7 and iPhone 7 Plus violations were found.
According to the Deputy head of FAS Andrey Tsarikovsky, in the near future Apple will be instituted administrative proceedings to recover the fine. As noted by the representative of the organization, its size will affect the number of mitigating circumstances, including cooperation “eppl Rus” with the service. In General, the representative of the FAS appreciated the outcome of the case and found that its results will contribute to the development of competition.
In August 2016, the FAS filed a case against American corporations suspected of coordinating prices for the iPhone 6. This was done after the citizen, who claimed that the 16 Resellers set the same prices for the iPhone 6s appeared in the Russian market in October 2015. Among them — MTS, “Beeline”, Re: Store, “Svyaznoy”, “MegaFon”, “Euroset”, “Citylink”, “M. Video”, “Eldorado”, OZON, Ulmart, Media Markt, “the Refrigerator.ru”, DNS, ION (Know-How) and “Technosila”.
As previously reported by the Deputy head of Department FAS on struggle against cartels Andrey Filimonov, if price collusion is proven, sellers can be fined in the amount of 1-15% of the total volume of sales of the iPhone 6s and iPhone 6s Plus in 2015.
In 2011, the Federal Antimonopoly service has studied the activity of the retail network operators MTS and “VimpelCom” (brand “Beeline”). Then the representatives of the FAS was interested in prices on the iPhone 4. After the inspection, both networks were fined 16 million and 18 million rubles, respectively.
