The court ordered “Vkontakte” remove song Leps and to pay the right holder of record payment

Arbitration court of St.-Petersburg and Leningrad region have sought 750 000 with the largest social network “Vkontakte” for the illegal placement of ten recordings by singer Gregory Leps. About it reports RIA Novosti.

Thus, the court granted the request of LLC “Nikitin Media digital Content”, which owns the exclusive related rights in works of Leps, including the right to communication to the public. Compensation 750 000 (75 000 for each track) became the largest in the Russian judicial practice. Also, the judge ordered the defendant to remove illegally posted works.

The trial lasted almost two years. In 2013, the Arbitration court has refused satisfaction of the claim of open company “Nikitin Media digital Content”, after which the company decided to appeal the decision in court on intellectual rights. Eventually, the case was sent for review. “VKontakte” tried to appeal this decision to the Supreme court, however, in the beginning of 2015 he refused satisfaction of the complaint.

Press Secretary of “Vkontakte” Giorgi Lubushkin reported that the social network intends to appeal the decision about deleting songs Leps. When it Lubushkin not answered the question whether the decision to remove these songs from free access.

We will remind that it not the first such court decision. June 30, the Arbitration court of St. Petersburg ruled that “Vkontakte” must delete 60 songs of the group “Aria” and “Korn”, copyrighted by the Studio “Union”. In addition, the Studio was awarded compensation in the amount of 600 000 rubles. Then the representatives of the social network also announced his intention to appeal the decision.
