According to Novichkova, the phone will remain as long as the Respondent fails to submit a request to return the goods of improper quality. He noted that the policy for recovery of money due to fraud with the amount of memory is not uncommon in the U.S., but in Russia this is the first time.

The plaintiffs claim that Apple specifies the memory that resides on the device initially, but in reality software “eats” a considerable part of the space, greatly reducing the amount actually available to the user memory.
