On 9 March the court decided to collect from the seller — company “Svyaznoy logistics” — 16 900 rubles (the cost of the phone), as well as compensation for moral damage in the amount of 1 000 rubles, a fine in the amount of 8 900 rubles, and the costs of the examination in the amount of 2 000 rubles.

According to Novichkova, the phone will remain as long as the Respondent fails to submit a request to return the goods of improper quality. He noted that the policy for recovery of money due to fraud with the amount of memory is not uncommon in the U.S., but in Russia this is the first time.

Earlier this week MacDigger reported that the Italian human rights organisation Altroconsumo complained that Apple in recent years sells iPhone and iPad with the declared 16 GB of internal flash memory, while in fact users can make up to 40% less.

The collective suit claims that the amount of internal memory is actually available to the user, acquired 16-Gigabyte versions of the iPhone and iPad is much smaller than declared by the manufacturer due to the “extravagance” of the operating system. The plaintiffs claim that Apple specifies the memory that resides on the device initially, but in reality software “eats” a considerable part of the space, greatly reducing the amount actually available to the user memory.
