“MegaFon” was fined 100 000 rubles for distribution of SMS advertising

Management of Federal Antimonopoly service across Moscow region has fined mobile operator “MegaFon” for distribution of SMS advertising without the prior consent of the subscribers. This was reported on the Agency’s website.

The amount of the fine amounted to 100 000 rubles. The basis for the sanctions part 1 of article 14.3 of the Federal law “On advertising”. As the statement of the Antimonopoly service, the operator is held liable “for the distribution of advertising without the prior consent of the subscriber or addressee to receive advertising.” Management said that in order for advertising to MegaFon used SMS-mailing.

“The decision on attraction of PJSC “Megaphone” to administrative responsibility under part 1 article 14.3 of the administrative offences Code of Russia and the imposition of a fine in the amount of 100 000 rubles for distribution of SMS advertising credit without the prior consent of the individuals to receive it”, — it is told in materials FAS.

According to the law “On advertising”, the operators have the right to send promotional messages only if the subscriber had previously given his consent. For violation of advertising legislation of the operator is imposed an administrative fine from 100 to 500 thousand roubles, specifies news Agency “Moscow”.

In early October near Moscow the FAS has already fined “MegaFon” for 200 000 rubles for distribution of advertising without the consent of the subscribers.
