“Beeline” was fined 600 000 rubles for sending users SMS advertising

Management of Federal Antimonopoly service (UFAS) across Moscow has fined mobile operator “VimpelCom” (brand “Beeline”), 300 thousand rubles for advertising SMS mailing list without the subscriber’s consent. This is stated in the message Department.

According to a posting on the Ministry’s website, Moscow regional OFAS Russia appointed the operator of the “big three” two of a fine in the amount of 450 000 and 150 000.

“The basis for initiation of proceedings was the fact that the distribution of PJSC “VympelCom” in the Moscow region SMS advertising without the prior consent of individuals to receive it, which is a violation of part 1 of article 18 of the Federal law from 13.03.2006 №38-FZ “On advertising”, — stated in the message.

The Ministry said that Beeline had already been brought to responsibility for violation of advertising legislation and the spread of SMS spam. “This demonstrates the reluctance of the offender to abandon the unlawful conduct,” — said in the message of FAS.

In June 2016, the Antimonopoly service fined “MegaFon” for SMS-spam to 1 million rubles (two fine of 500 thousand rubles). Then in the FAS said that if the decision took into account the fact that earlier “the Megaphone” has already been prosecuted for similar violations. The operator called the penalty in 1 million roubles commensurate with the violation.

For violation of advertising legislation of the operator is imposed an administrative fine from 100 to 500 thousand rubles.
