The Federal customs service (FCS) explained his decision not to let in Russia, Xiaomi smartphones from foreign online stores. According to RBC, the Agency acts at the request of the owner of the brand in the Russian market.
In late April, the public organization “Roskomsvoboda” reported that some Russians who have bought smartphones in the foreign Internet-stores, faced difficulties in obtaining equipment in Russia. FCS became a “wrap” on the border, Xiaomi smartphones. In this case, the Agency relied on the rules of importation of goods into the customs territory of the Eurasian economic Union (EEU), which among other things prohibited the shipment of counterfeit and pirated items.
TCF is governed by article 18 of the universal postal Convention (signed in Doha on October 11, 2012), which prohibits the inclusion in any shipment of counterfeit and pirated products, explained the service representative. Customs officers cannot determine whether the goods are counterfeit, so they are guided by instructions from the copyright holder.
“The recognition of counterfeit goods to the competence of the customs authorities is not true. Determine whether the products identified by the customs authorities, signs of violation of intellectual property rights (counterfeit), rests with the copyright holder. If the information provided by the right holder, moving the goods is counterfeit, the customs authorities shall take measures to prevent the importation into Russia of prohibited goods arriving by international mail, and ensure their immediate removal from the country”, – stated in the press service of the FCS.
The representative of the company RDC Group, which through its structure of “Smart orange” owns the rights to the brand Xiaomi in Russia, confirmed the cooperation with the customs. According to him, customers for the sake of guarantee is to use only the official sales channels — stores RDC Group in Moscow, St. Petersburg and Vladivostok, salons of mobile operators and major retailers, as well as the Russian online store of Xiaomi.
At the end of April 2017, Russian media reported about several cases, stops at the border ordered by individuals from Russia of Xiaomi smartphones. Buyers point out that the Chinese stores sell mobile devices at prices much lower lower than the official Russian reseller.
