Apple failed to stop the lawsuit filed by patent Troll Smartflash, and Samsung has turned out

The U.S. court of appeals for the Federal circuit refused to stop the proceedings in a patent lawsuit against Apple. Patent Troll Smartflash in February won the lawsuit against Apple, which was ordered to pay a fine for infringement of patents. Last month, a judge overturned a jury’s decision, assuming that the latter could correctly estimate the size of payments. But the matter was not closed.

Apple tried to stop the process, but the U.S. court of Appeals for the Federal circuit denied the iPhone maker. Thus, the proceedings will continue and the Californian giant will likely have to pay a fine.

In parallel with Smartflash sued Samsung, but the South Korean company has been able to convince the court to stop the process. The decision was based on the validity of figueruela in the company’s patents.

Earlier this month, U.S. district judge Rodney Gilstrap overturned the initial verdict, saying that his instructions to the jury could influence the final assessment of damages. Apparently, the court of appeal decision will be made in September recalculation of damages Smartflash.
